Data Protection Procedures
La Sicilyana Wines – Data Protection & Subject Access Request (SAR) Procedure
This procedure sets out how La Sicilyana Wines handles data protection complaints and Subject Access Requests (SARs) in accordance with the UK GDPR, the Data Protection Act 2018, and the Data (Use and Access) Act 2025.
Receiving a Request
Any verbal or written request for personal data will be treated seriously and recorded immediately. Requests may arrive by email, letter by post or in person.
The need of confirmation from the requester
If there is uncertainty about the identity of the requester, La Sicilyana Wines will firstly verify identity promptly and proportionately. Formal photo ID will be requested where necessary. Alternative verification methods may include confirming order references, booking details, account information, or other details known only to the requester.
Checking the Request is Valid
Where a request is submitted on behalf of another person, written authority or evidence of power of attorney must be provided before disclosure. In most cases, children aged 12 or over may exercise their own data rights before we will disclose any information.
Response Times and Reminders
La Sicilyana Wines aim to respond within one calendar month from receipt of a valid request. The time limit begins once identity verification or clarification has been completed if required.
Important timing rules:
- Requests received on weekends or holidays still count from that date.
- If the deadline falls on a weekend or public holiday, the next working day applies.
- Requests received on the 31st of a month may fall due on the final day of the following shorter month.
Complex or multiple requests may be extended by up to two additional months where legally permitted. The requester will be informed before the original deadline expires.
Clarify the Scope of the Request
Where appropriate, La Sicilyana Wines may contact the requester to clarify exactly what information is being requested. This may reduce delays and assist with accurate searches.
Impact on Other Individuals
Where documents contain information relating to third parties, La Sicilyana Wines will balance the requester’s rights against the privacy rights of others. Information may be disclosed in full, partially redacted, or withheld entirely depending on circumstances and legal obligations.
Manner of Response
Responses will normally be provided in the same format as the original request unless the requester asks otherwise. All requests and disclosures will be checked carefully before any form of information is sent out.
